Marriage Visa Australia — What You Need to Know

A marriage visa in Australia is officially a partner visa. If you are married to an Australian citizen or permanent resident, you apply under subclass 820/801 (onshore, if you are in Australia) or subclass 309/100 (offshore, if you are outside Australia). If you are engaged but not yet married, the Prospective Marriage visa (subclass 300) - often called the fiancé visa - is the pathway. Married overseas? You can still apply for an Australian marriage visa from your home country. Our MARA registered agent assesses your marriage visa eligibility and confirm which pathway applies to your situation.

Common Questions

Partner Visa FAQs

How long does a partner visa take in 2026?
Processing times vary by pathway and by how complete your application is at lodgement. Indicative current ranges:
Visa Indicative processing time
Onshore Partner Visa (820/801) 12–24 months
Offshore Partner Visa (309/100) 18–36 months
Is a spouse visa the same as a partner visa in Australia?
Yes. In Australia there is no separate “spouse visa” — married partners apply under the partner visa subclasses (820/801 onshore, or 309/100 offshore). “Spouse visa,” “wife visa,” and “husband visa” are common everyday names for the same partner visa pathway.
What is a fiancé visa, and is it the same as a prospective marriage visa?
Yes. The fiancé visa is officially the Prospective Marriage visa (subclass 300). It’s for couples who are engaged and intend to marry in Australia. After marrying, you apply for a partner visa to remain permanently.
Do you handle de facto partner visa applications?
Yes. De facto couples — including same-sex couples — can apply for a partner visa (subclass 820/801 onshore, or 309/100 offshore), provided the relationship meets the Department’s requirements. Our MARAregistered agent assesses your situation and advises on the evidence you’ll need.
Can I apply for a partner visa from outside Australia?
Yes. If your partner is overseas, the offshore partner visa (subclass 309/100) is designed for applicants applying from outside Australia. If you’re already in Australia, the onshore partner visa (subclass 820/801) applies. Our MARA-registered agent confirms the right pathway during your free assessment.
What is the difference between the 820 and 309 visa?
The subclass 820 is an onshore visa — it's for applicants who are already in Australia at the time of application. The subclass 309 is an offshore visa — it's for applicants who are outside Australia when they apply. Both lead to permanent residency (801 and 100 respectively).
Can same-sex couples apply for a partner visa in Australia?
Yes — absolutely. Australian partner visas are fully equal regardless of gender or sexual orientation. Same-sex married couples and same-sex de facto couples are eligible for exactly the same visa pathways as opposite-sex couples. The requirements and process are identical. We welcome all couples and relationship types.
Can an Australian Permanent Resident sponsor their partner?
Yes — both Australian citizens and permanent residents can sponsor their partner for a partner visa. Many people don't realise that PR holders have the same sponsorship rights as citizens. Book a free assessment and we'll confirm your eligibility and the best pathway for your situation.
What evidence do I need for a partner visa?
The Department requires evidence across four categories: financial aspects of your relationship, the nature of your household, social aspects of your relationship, and your commitment to each other. We help you identify and organise all the evidence needed to build the strongest possible application.
What if my visa was refused?
A refusal is not the end. Depending on your situation, you may be able to apply to the Administrative Review Tribunal (ART) for a review, or reapply with a stronger application. Book a consultation so we can review exactly what happened and advise on the best path forward.
Do I need a migration or immigration agent, or can I apply myself?
You can apply without an agent, but partner visas are one of the most document-intensive visa types. One missing document or incorrect information can cause significant delays or a refusal. Most clients find that professional help saves time, stress, and money in the long run.

Partner Visa Sponsorship in Australia

Every partner visa application needs an approved sponsor. If you are an Australian citizen or permanent resident sponsoring your partner, we handle both sides of the application - the sponsorship and the visa. We assess your eligibility to sponsor, prepare your sponsorship documents, and manage the relationship evidence the Department requires. Partner sponsorship has its own criteria and limits, and we confirm all of it during your free assessment.
